Refer to Pierce's Foster Genealogy page 486. However, we believe Pierce has the wrong parents for this Richard.

Estate Administration in Prerogative Court of Canterbury 3 May 1630. He died Intestate (without a will) and the care of his minor children was assigned to his brother-in-law (John Bigge). The children named were: Mary, John, and Hopestill. relic (widow) Patience renounced the court findings. Richard and Patience had two male children named John both died young (before 1630). There is no baptism record in Biddenden for a third son John. However, Richard's brother Thomas had a son John (b. 1610) and Thomas died in 1626.

SPECULATION: It is possible that Thomas' son John was taken in by Richard - thus there would be a minor child John in Richard's household when Richard died in 1630.

Sailed to Massachusetts on ship Elizabeth (1635)

The ship's list includes a Patience Foster, age 40, which places her birth about 1595. She sailed with her son Hopestill and her mother Rachel, widow of John Bigge. The ship passenger manifest has wrong age for Rachel.

When Patience's husband, Richard Foster, died without a will his estate was administrated by the Court and care of minor children (John, Mary, and Hopestill) was given to Patience's brother John Bigge who was born Jun 29, 1598 and would be age 32 in 1630. Patience renouced the decision of the Court.

We do not know what happened to the minor child John Foster given to John Bigge. It is unlikely the minor child is our ancestor, but for now we retain information about this Foster family as a possible connection.

When she sailed to Massachusetts she would have been about age 70, not age 6 as was recorded on the passenger list. Age 6 is accepted as a clerical error by the originator back in 1635; there was probably supposed to be another digit after the 6, e.g, an 8 or 9. She sailed with daughter Patience, widow of Richard Foster and grandson Hopestill.
